3. Product Information & Disclaimers
All power wheelchair, mobility scooter and accessory descriptions, images, specifications and pricing are provided in good faith for reference only. We reserve the right to adjust product specifications, colors, dimensions, stock availability and pricing without prior notice due to manufacturer updates, supply chain changes or inventory fluctuations.
We disclaim all implied warranties of merchantability and fitness for a particular purpose to the fullest extent permitted by Georgia law. Product photos are illustrative only and minor visual differences do not constitute product defects. Customized, modified or altered mobility equipment is not eligible for standard warranty coverage.
4. Order Processing, Cancellation & Rejection
After payment authorization, we will review all orders. Mogo Mobility retains the right to accept, delay, decline or cancel any order for valid reasons including but not limited to pricing errors, inventory shortages, suspected fraudulent transactions, invalid shipping addresses, or violation of these Terms.
Per FTC Mail, Internet, and Telephone Order Merchandise Rule, if we cannot ship your order within the communicated timeline, we will notify you and offer full order cancellation with a complete refund at no extra cost to you. You may cancel your unshipped order at any time prior to dispatch by contacting our customer support team.
5. Pricing, Tax & Payment Terms
All product prices are stated in United States Dollars (USD). Sales tax will be calculated and added at checkout based on applicable state and local tax rules for your shipping address.
Accepted payment methods include CardConnect, PayPal, ACH Bank Transfer, Affirm and Klarna financing. All payment transactions are processed by secure third-party payment providers. We do not store full credit card or bank account credentials on our servers. Financing approval is solely determined by Affirm or Klarna, and repayment obligations are between you and the financing provider. Failed payments may result in order cancellation and administrative recovery fees where permitted by law.
6. Shipping & Delivery
All shipping timelines displayed on the website are non-binding estimates. Delays caused by carrier disruptions, weather, holiday backlogs, freight logistics for large power wheelchairs, or customs matters are outside our control and shall not entitle you to order cancellation or compensation unless caused by our own error. All shipping rules are fully governed by our separate Shipping Policy.
7. Returns, Refunds & Exchanges
All return, refund, exchange and restocking fee rules are set forth in our official Return & Refund Policy, which is incorporated into these Terms by reference. Non-returnable customized, clearance and hygiene-restricted mobility items are clearly marked on relevant product pages.
8. Product Warranty
Each power wheelchair and mobility device is covered by the manufacturer’s written limited warranty provided at the time of delivery. Warranty coverage excludes damage from improper use, unauthorized modification, accident, neglect, normal wear and tear, or third-party repair without factory certification. Warranty claims shall be processed in accordance with our separate Warranty Policy.
9. Intellectual Property
All website text, product photographs, diagrams, logos, trademarks, graphics, video content, design layout and product copy are the exclusive property of Mogo Mobility Inc. or used under valid license. You may not copy, reproduce, distribute, scrape, resell, modify or publicly display any website content without our prior written permission.
By submitting product reviews, customer photos or feedback to our website, you grant Mogo Mobility a perpetual, non-exclusive, royalty-free license to use such content for marketing, website display and promotional purposes.
10. User Conduct & Account Termination
You agree not to misuse our website, submit false information, place fraudulent orders, infringe third-party intellectual property rights, or post harmful, harassing or defamatory content in reviews or contact forms. We reserve the right to suspend or permanently restrict your website access, account and ordering privileges at our sole discretion for violation of these Terms, without prior refund liability except for fully paid undelivered merchandise.
11. Limitation of Liability
TO THE FULLEST EXTENT ALLOWED BY GEORGIA AND FEDERAL LAW:
- Mogo Mobility shall not be liable for any indirect, incidental, consequential, special or lost profit damages arising from website use, product purchase or equipment performance;
- Our total aggregate liability for any claim related to your order, website access or product shall not exceed the total amount you paid to Mogo Mobility for the relevant product within the prior 12 months;
- The above limitations do not apply to liability for bodily injury or death caused by our negligence, fraud, intentional misrepresentation, or claims under the Magnuson-Moss Warranty Act, which cannot be contractually waived.
12. Privacy & Tracking Technologies
Your use of the website is governed by our Privacy Policy and Cookie Policy. We collect and process personal information to fulfill orders, provide customer service, comply with legal obligations, and deliver targeted marketing as permitted by CCPA/CPRA for California residents.
