1. Introduction
Mogo Mobility Inc. (“we”, “us”, “our”) respects your privacy and protects your personal and sensitive information when you browse our website, purchase or rent mobility equipment, receive repair/warranty services, contact customer support, apply for financing, or interact with our marketing communications. This policy governs all collection, use, storage, sharing and retention of your data, and supersedes any conflicting oral or informal statements. Any ambiguous terms shall be interpreted consistent with applicable U.S. federal and state privacy laws.
Our products and services are intended solely for users aged 18 or older. We do not knowingly collect personal information from children under 16 per COPPA. If we accidentally obtain minor data, we will delete such records promptly upon discovery. Minors under 18 may not use our platform without valid adult supervision.
2. Services & Third-Party Platform Disclaimer
We offer mobility equipment sales, long/short-term rentals, equipment repair, warranty administration, logistics delivery, customer support, financing referral, and website operation services.
Our website links to third-party payment processors, shipping carriers, analytics tools, advertising pixels, and external partner sites. We do not control their data practices, and all third-party data handling follows their independent privacy policies. You assume full risk when submitting data to external platforms. You warrant all information you submit to us is true, accurate and lawfully provided, and you are liable for losses arising from unauthorized data submission.
3. Information We Collect
We only collect information reasonably necessary to complete transactions, deliver services, prevent fraud, meet tax/legal obligations, and improve our platform. Collected data includes:
- Identification & Contact Data: Full name, phone number, email address, billing and physical shipping addresses, account username, encrypted login credentials, and user preference settings.
- Transaction & Financial Data (GLBA / California CFA regulated): Order records, rental agreements, payment history, invoices, refunds, service contracts, and financing application details. We accept credit cards, debit cards, ACH transfers, PayPal, CardConnect, Affirm and Klarna. We never store full credit card or complete bank account numbers; all payment processing is managed by secure third-party payment vendors.
- Service Records: Wheelchair/mobility device purchase/rental logs, repair history, warranty documents, support tickets, and customer feedback.
- Technical & Analytics Data: IP address, device model, browser type, website access timestamps, click activity, cookies, and anonymous behavioral analytics. We do not collect precise GPS location data unless you explicitly opt in; only general regional location derived from IP may be captured.
- Communication Records: Support call logs, chat transcripts, email correspondence, survey responses, and event participation records.
- Sensitive Personal Information: Financial credentials, identity verification materials, and voluntary mobility/health details you share only for order fulfillment and fraud screening.
We may adjust collected data categories to match business updates or new legal requirements, provided such changes align with the core purposes outlined in this policy.
4. How We Use Your Information
We process your personal data on lawful bases including contract performance, legitimate business interest, legal compliance, and your voluntary consent where required. Authorized uses include:
- Process sales, rental, warranty, repair and after-sales contractual obligations;
- Complete payment settlement, identity verification, fraud detection and risk control;
- Maintain website functionality, system security, and optimize user experience;
- Send mandatory transaction alerts, delivery updates, warranty reminders and safety notices;
- Conduct internal accounting, tax filing, audit work, and preserve evidence for disputes;
- Deliver marketing emails/SMS and behavioral advertising (you may opt out of marketing separately);
- Respond to government inquiries, court subpoenas, and comply with all federal/state legal requirements;
- Support corporate restructuring, asset transfers, and internal affiliate unified operations.
Mandatory service notifications (order confirmations, safety recalls, warranty expiration alerts) cannot be unsubscribed; opting out of marketing does not pause data processing required to fulfill your active orders or legal duties.
5. Sharing & Disclosure of Your Information
We do not sell your personal information as defined under CCPA/CPRA and all U.S. state privacy statutes. We may share your data only in the following limited scenarios, and you consent to such disclosure:
- Authorized Service Vendors: Payment processors, shipping carriers, cloud hosting providers, IT maintenance partners, marketing agencies, legal and accounting firms, and repair subcontractors. All third-party processors sign data protection agreements; we are not liable for third-party breaches outside our reasonable oversight.
- Financing Partners (Affirm / Klarna): If you apply for installment financing, we share only necessary information to complete your credit application. All credit approval decisions are made solely by the financing provider, and we do not store your full credit report or credit score. You may contact the financing company directly to manage your credit data.
- Corporate Transactions: In mergers, acquisitions, asset sales, reorganization or bankruptcy proceedings, your customer data may transfer as business assets to the successor entity, who will assume all privacy obligations under this policy.
- Legal Required Disclosure: We release data to courts, regulatory agencies, or law enforcement when bound by valid legal orders.
- Risk & Safety Protection: We may disclose records to prevent fraud, cyberattacks, property loss, or threats to personal or platform security.
- Affiliate Sharing: Data may be shared with our affiliated companies for unified risk management and consistent service delivery.
We bear no liability for disclosures completed in compliance with this policy and U.S. law.
6. Cookies & Tracking Technologies
We use essential cookies, pixel tags, log trackers, Google Analytics, Google Ads and Meta Pixel tools to run core website functions, analyze traffic, and deliver targeted advertising.
- Necessary functional cookies cannot be disabled; without them, checkout, login and order tracking features will fail.
- Non-essential analytics and advertising tracking may be turned off via our website cookie preference panel.
We honor global opt-out signals required by state privacy laws, but reserve the right to retain anonymized security logs and compliance records regardless of your marketing opt-out selection.
7. Data Retention
We retain your data only as long as legally or operationally required, following these standard retention rules:
- Tax, financial, contract and full transaction records: Minimum 7 years to meet U.S. federal and state tax and commercial recordkeeping rules;
- Active rental, warranty, repair and unresolved customer dispute data: Retained until all contractual obligations, warranty terms and disputes are fully closed;
- Security logs, fraud prevention records and call recordings: Retained for 3 years or longer per internal compliance rules;
- Marketing contact data: Stored until you unsubscribe; de-identified behavioral data may be kept indefinitely for platform optimization;
- Data required for audits, legal investigations or pending litigation may be retained beyond standard timelines at our sole discretion.
You may not demand deletion of records we must retain for tax compliance, ongoing contracts, fraud control, or active legal disputes.
8. Data Security
We implement commercially reasonable technical, administrative and physical safeguards including end-to-end encryption, staff access restrictions, vendor security audits, and internal confidentiality training to protect your personal and sensitive information.
No online transmission or digital storage system can guarantee 100% security. We are not responsible for data loss caused by hacking, unauthorized third-party breaches, your improper account management, or force majeure events.
If a data security breach occurs, we will notify affected users only to the minimum standard required by all applicable U.S. state data breach notification laws, with no additional compensation liability beyond statutory legal obligations.
9. Your Statutory Privacy Rights
Consistent with all federal and state U.S. privacy laws, you hold the rights listed below, subject to legal and business exceptions outlined in this document. All requests require identity verification, and we may reject anonymous, duplicate, excessive or malicious submissions.
- Right to Access: Request a copy of all personal data we store about you. We may deny requests that expose other users’ privacy, trade secrets, or create unreasonable operational burden.
- Right to Correction: Request updates to inaccurate personal contact or profile information. Completed financial records, tax logs and closed transaction history cannot be modified arbitrarily.
- Right to Deletion: Apply to erase your personal data. We may fully or partially deny deletion if: you hold an active rental, unexpired warranty or unpaid balance; records are required for tax/legal retention; fraud risk control is ongoing; disputes or legal proceedings are unresolved; or deletion harms legitimate business or third-party interests.
- Right to Data Portability: Request machine-readable copies of your transaction and profile data. We may withhold internal system logs and proprietary business information.
- Right to Opt Out of Targeted Advertising: Disable behavioral marketing tracking at any time via our cookie settings or unsubscribe links in emails. This will not interrupt transactional service communications or mandatory data processing for order fulfillment.
- Right to Non-Discrimination: We will not deny core services to users who exercise their privacy rights. We may reasonably limit certain platform functions if you restrict our data collection, which does not qualify as discriminatory treatment.
- Right to Appeal: If your privacy request is denied, you may submit a formal appeal via our listed contact channels. Our final review decision is conclusive.
