Warranty Policy

Effective Date: July 20, 2026

1. Warranty Coverage

Mogo Mobility Inc. provides a limited manufacturer’s warranty on brand-new electric wheelchairs, mobility scooters, and original replacement parts sold through retail and wholesale channels across the United States. Detailed warranty terms for each model are specified on the product page, in the user manual, and on the warranty card included with the product. This policy applies to both individual end-user consumers and wholesale merchants who purchase devices for resale.

2. Warranty Commencement Date

The warranty period for all products begins on the date of the original purchase invoice, regardless of the actual delivery date. Warranty periods for frames, motors, batteries, controllers, seat assemblies, and various small accessories vary and are subject to the specifications stated in the product documentation. Any time elapsed due to shipping delays, warehousing, or idle non-use does not extend the warranty period.

3. Warranty Coverage – Eligible Failures

Subject to the exclusions set forth in Section 4, if a product fails under normal use conditions solely due to defects in raw materials or manufacturing processes, Mogo Mobility will, at its sole discretion, repair or replace the defective part. Covered failures include:

1. Frame cracks or welding process defects;
2. Manufacturing defects in drive motors, electronic controllers, or wiring harnesses;
3. Manufacturing defects in original batteries during the battery-specific warranty period;
4. Factory defects in the original braking system, joystick, or charging port.

4. Warranty Exclusions (Not Covered)

This limited warranty does not cover damage or failure resulting from the following:

1. Normal wear and tear of tires, armrest pads, seat cushions, footrests, grips, and plastic exterior components;
2. Overloading, off-road use, collisions, drops, submersion in water, accidents, or other misuse;
3. Unauthorized modifications, disassembly, third-party repairs, or installation of non-original parts without Mogo Mobility’s written consent;
4. Improper maintenance, failure to charge as specified in official guidelines, or prolonged storage in extreme heat or cold;
5. Cosmetic damage such as scratches, dents, discoloration, or stains occurring after delivery;
6. Damage resulting from self-transportation without original factory packaging protection;
7. Loss of the entire unit, keys, chargers, or other consumable accessories.

5. Warranty Claim Process

To submit a warranty claim, the original purchaser must provide the following materials to customer service:

1. Original sales invoice or purchase receipt indicating the purchase date, product model, and device serial number;
2. Clear photos or videos fully showing the fault location and damage;
3. A detailed written description of the failure and the circumstances under which it occurred.

We will first conduct remote technical troubleshooting and, upon confirmation of the fault, approve a repair/replacement plan. All claims must be submitted within the applicable warranty period.

6. Resolution Upon Warranty Approval

Upon verification and approval of a warranty claim, Mogo Mobility has the sole discretion to choose any of the following remedies:

1. Provide a new replacement part for customer self-installation;
2. Arrange for factory-level repair of the entire unit;
3. Replace the entire unit with an equivalent or upgraded model;
4. Provide a purchase credit in accordance with Georgia consumer laws.

Shipping costs associated with warranty claims are allocated in accordance with the *Retail and Wholesale Shipping Policy*.

7. Warranty Transferability and Limitations of Liability

1. This limited warranty is valid only for the original purchaser (i.e., the end-user retail customer or wholesale merchant named on the invoice) and is not transferable to subsequent owners or second-hand buyers.
2. To the fullest extent permitted by Georgia and U.S. federal law, any implied warranties of merchantability or fitness for a particular purpose are limited to the duration of this written limited warranty.
3. Mogo Mobility shall not be liable for any indirect, incidental, or consequential damages arising from device failure, including but not limited to loss of revenue, medical expenses, mobility equipment rental costs, or business interruption losses.

8. Wholesale Merchant-Specific Provisions

For wholesale dealers purchasing inventory for resale:

1. The warranty period for wholesale inventory begins on the wholesale invoice date, not the date of retail sale to the end user;
2. Wholesale customers must perform basic troubleshooting and filter out invalid warranty claims before submitting them to Mogo Mobility for processing;
3. Bulk warranty replacement parts shipments are subject to wholesale order terms and minimum order quantity requirements.

9. Governing Law

This Warranty Policy is governed by the substantive laws of the State of Georgia, USA. All warranty-related disputes shall be resolved in accordance with the dispute resolution provisions set forth in the *Terms of Service*.

10. Policy Updates

Mogo Mobility Inc. reserves the right to revise this Warranty Policy at any time. Updated versions will be posted on the official website with a new effective date. Continued purchase or use of our products constitutes acceptance of the most current policy terms.
